- Collection of Past Due Amounts We look to all
possible sources for repayments of debt, including the direct
debtor, personal or corporate guarantors, or any other party
that may have financial responsibility for the transaction.
Our approach is customized, based on our evaluation of the credit
standing and repayment potential of each of the parties involved.
- Restructuring of Debt We assess whether the
debtor may be able to make reduced payments, in which case we
consider modifying the repayment terms so the periodic payments
are smaller and the time for repayment is extended. The reduced
payments may be either temporary, gradually stepping back up
to the original payment pattern, or may be permanent, depending
on the debtors projected cash flows.
- Repossession and Remarketing of Collateral If
necessary, we repossess, with or without the cooperation of
the debtor, the collateral supporting the debt obligation. We
then sell the collateral as a secondary means of repayment.
- Initiation and Supervision of Litigation We
attempt to resolve defaulted transactions without resorting
to time-consuming and expensive litigation. However, if required,
we engage legal counsel in either Federal or state court to
collect monetary deficiencies and/or to force the return of
collateral.
- Pursuit of Creditors Rights in Bankruptcy
If debtors or related guarantors file for bankruptcy protection,
we file proofs of claim with the bankruptcy trustee, monitor
the bankruptcy proceedings and collect any distributions from
the bankruptcy estate. We also press the debtor in bankruptcy
to promptly assume or reject leases or other contractual arrangements
involving our clients.
